Terms of Service

1. The service

boostme for admin analyzes the website and assets you register, generates advertising creatives (images, text banners and videos) with AI, publishes ads from advertising accounts managed by us on third-party platforms (such as X, Meta, Google, TikTok and LinkedIn), and continuously optimizes budget allocation and delivery.

Parts of the service may run in a demo mode that simulates delivery when a platform is not connected. The dashboard indicates which platforms deliver live ads.

2. Accounts

• You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account.
• You must be at least 18 years old and use the service for business purposes.
• We may suspend accounts that violate these Terms or put the service, our advertising accounts or other customers at risk.

3. Budgets and cancellation

• You can pause or stop a campaign at any time from the dashboard.
• The campaign budget determines the total ad spend delivered on the platforms.

4. Approvals and your responsibilities

• Generated creatives are not published until you approve them, unless you enable automatic approval in settings.
• You are responsible for the accuracy and legality of the business information, offers and assets you provide, and you warrant that you own or have licensed the rights to all uploaded material.
• You must ensure your products, services and landing pages comply with the laws of the regions you target.

5. Prohibited use

• Advertising illegal products or services, or content that is deceptive, discriminatory, or infringes third-party rights.
• Content that violates the advertising policies of the delivery platforms.
• Attempting to disrupt, reverse engineer or gain unauthorized access to the service.
• Reselling the service without our written consent.

6. Ad platform policies

Ads are subject to review by the third-party platforms and may be rejected, restricted or removed by them at any time. We may decline or stop publishing content that we reasonably believe risks the standing of the advertising accounts we operate. Platform review outcomes are outside our control.

7. Intellectual property

• You retain all rights to the materials you provide. You grant us a license to use them to analyze your business and to create and run ads for you.
• We grant you a non-exclusive, perpetual license to use the creatives generated for you in your own marketing, on and off the service.
• The service, its software and its branding remain our property.

8. Disclaimers

The service is provided "as is". We do not guarantee any particular advertising result, including impressions, clicks, conversions or sales. AI-generated content may contain errors; you are responsible for reviewing creatives before approving them.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of the service is limited to direct damages, and we are not liable for indirect, incidental or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Changes and termination

We may update the service and these Terms. For material changes we will give reasonable advance notice by email or in the dashboard; continued use after the effective date constitutes acceptance. Either party may terminate at any time; sections that by their nature survive (IP, disclaimers, liability) survive termination.

11. Governing law and venue

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance for disputes arising out of the service, except where mandatory consumer protection rules of your country of residence provide otherwise.
